By downloading, installing, or using the Makenai app or website, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
These terms apply to all users, including guests and registered account holders. Our Privacy Policy explains how we handle your data.
Makenai is a Japanese language learning app using spaced repetition (SRS) to help users memorise grammar, vocabulary, and kanji. The app operates offline by default; an optional account enables cloud sync across devices.
We may update, expand, or discontinue features at any time. We will make reasonable efforts to notify users of significant changes.
You may use Makenai without an account (guest mode). Creating an account requires a valid email address. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
You must be at least 13 years old, or the minimum age for digital consent in your country, to create an account, unless a parent or guardian has agreed to these terms for you. By registering, you represent that you meet this requirement.
We reserve the right to suspend or terminate accounts that violate these terms.

We may rate-limit, suspend or terminate access, and remove content, without notice if we reasonably believe you are breaching these terms, abusing the service or putting other users or our infrastructure at risk.
Makenai is currently free and has no in-app purchases. If we introduce paid features, they will be processed by Apple (App Store) or Google (Google Play) under their terms and refund policies, and we will show the price before you buy. We do not handle payment card information directly.
The app's code, design, SRS algorithm, name and logo, and our original explanations are owned by us and protected by intellectual property law. You may not copy, redistribute or create derivative works from them without our written permission.
Some study content comes from third parties under open licenses, and those licenses, not this section, govern your use of it:
"JLPT" refers to the Japanese-Language Proficiency Test. Makenai is not affiliated with, endorsed by or sponsored by the Japan Foundation or Japan Educational Exchanges and Services, which administer the test.
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or that any defects will be corrected.
Makenai is a study aid. Translations, readings, grammar explanations, JLPT level groupings and other content may contain errors, and we do not guarantee any learning outcome or exam result. Do not rely on the app as your only source for important decisions, translations or official exam information.
To the fullest extent permitted by law, Makenai and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress or profits, arising from your use of or inability to use the service, even if advised of the possibility of such damages.
Our total liability for any claim arising from these terms or the service shall not exceed the greater of the amount you paid us in the 12 months preceding the claim or USD 50.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including your statutory rights as a consumer.
To the extent permitted by law, you agree to indemnify and hold harmless Makenai and its operators from claims, losses and costs, including reasonable legal fees, arising from your breach of these terms or your misuse of the service.
If you downloaded Makenai from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. The same applies to Google if you downloaded the app from Google Play.
These terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law rules. Any dispute will first be resolved through good-faith negotiation; if it is not resolved within 30 days, it will be submitted to the exclusive jurisdiction of the competent courts of the Philippines.
If you use Makenai as a consumer, this does not take away the protection of mandatory consumer laws in the country where you live, or your right to bring a claim in your local courts where that law allows it.
We may revise these terms from time to time. The effective date at the top of the page reflects when the current version was last revised. We will notify registered users of material changes by email or in-app notice. Continued use of the service after the effective date constitutes acceptance of the revised terms.
